Questions

How is statutory redundancy pay worked out in Jersey?

One week's pay for each full year (12 calendar months) of continuous service, once you have at least 2 years. A week's pay is capped at the latest mean weekly earnings figure: £1,100 for leaving dates from 22 September 2026.

Is redundancy pay on top of notice?

Yes. Redundancy pay is separate from notice pay and any untaken holiday, which are owed whatever the reason for leaving.

How much is an unfair dismissal award in Jersey?

A fixed number of weeks' pay set by length of service, from 4 weeks (up to a year) to 36 weeks (more than 15 years). Since 25 July 2025 the Tribunal can add up to 25% for the employer's conduct, and it can reduce the award if the employee contributed.

What makes a compromise agreement valid?

It must be in writing, relate to the particular claim, name the independent adviser who advised the employee (a lawyer, or a certified union or advice-centre adviser with insurance), and state that the legal conditions are met. Otherwise an agreement can't stop a Tribunal claim, unless it's reached through JACS conciliation.

How long do I have to claim?

An unfair dismissal complaint must reach the Jersey Employment and Discrimination Tribunal within 8 weeks of the effective date of termination. A redundancy payment has to be claimed within 6 months.

An estimate, not legal advice. Week's pay is basic gross pay; for variable hours the law uses a 52-week average (JACS guide). Doesn't cover discrimination awards, contractual enhanced redundancy, bonuses or tax. Free impartial advice: JACS, 01534 730503.
